Out-of-State Custody Order: What to Gather Before You Act

Out-of-state custody problems usually get more confusing when the basic documents and timeline are not in one place. If a child is in immediate danger, call 911. If you believe a child is missing, contact local law enforcement immediately. Do not wait for a PI consultation, a report or repeated incidents. Preserve records only when safe and without delaying help. Once immediate safety needs are addressed, gather the order, court information, known current locations, and move or exchange chronology.

What To Gather First

1) The Current Order and Court Information

Gather the complete current order, issuing court, case number and any later modifications. Give those documents to counsel and the investigator rather than relying on a remembered provision or a single page.

2) Registration or Filing Status

Collect any Washington registration or related filing documents and note what action has already been taken. Counsel can assess the order’s status and the next legal step from the actual record.

3) Current Address and Movement Facts

List known addresses, recent travel, vehicle information, school changes and caregivers, with the date and source of each fact. Label unconfirmed reports so they are not mistaken for current verified locations.

4) The Move or Non-Return Timeline

Record the agreed exchange or return, relevant messages and the dates of any move or missed return. Identify the point at which the child’s location became uncertain and any later information received.

Where Investigation Support Fits

Residence Verification

A defined locate or residence task can help check a reported address through lawful research and observation. The findings should state when the location was linked to the person and what remains uncertain.

Build the Move and Exchange Timeline

We can organize the order dates, moves, communications and exchange events into a source-linked chronology. Counsel can use it to assess the factual sequence behind the legal question.

Plan Factual Work With Counsel

Ask counsel which location or timing fact needs independent support. Share that question and the relevant orders so the investigative task supports the legal process without attempting to decide it.

Registration vs Enforcement

Registration Questions

Confirm what order and modifications are in the file and what registration or related action has occurred in Washington. Counsel determines which documents and process are required.

Enforcement Questions

If the concern is compliance, document the current location, scheduled return and what actually happened, including any facts suggesting concealment of the child’s location. Having an order does not eliminate the need to establish those facts for legal review.

Out-of-State Custody FAQ

Do I need the full order before taking action?

Gather it as early as you can, but do not delay emergency help or reporting a missing child while looking for paperwork. For subsequent legal and investigative planning, the complete order and modifications help identify the applicable arrangements.

Does current residence still matter even if I have an order?

Yes. An order describes the legal arrangement; current residence and movement records help show what is happening. Provide dates and sources for the location information you have.

Can a PI decide the jurisdiction issue?

No. Jurisdiction and registration are questions for counsel and the court. A PI can verify a location lead and document the movement or exchange timeline.

Is registration the same thing as enforcement?

No. Registration concerns the order’s status through the applicable process; enforcement concerns action on its requirements. Ask counsel which step is needed and provide the filing record and current compliance facts.

When is locate work useful here?

It may help when a residence, school-location lead, travel pattern or return status needs lawful verification. Missing-child concerns should be reported to law enforcement immediately; PI work must not delay that response.

Need help clarifying location facts tied to an out-of-state custody issue?

After immediate safety and reporting needs are addressed, share the order and dated location information with counsel. We can discuss a lawful, defined task to check a residence lead or document the movement timeline.
