Preparing to Register an Out-of-State Custody Order in Washington

Gather the complete custody orders, later modifications and issuing-court details before discussing registration in Washington. Keep required notice information separate from any current dispute about a missed return or location. Counsel can identify the determination to register and assess whether enforcement or another legal step is also needed.

Registration File Basics

Keep the complete order history together and flag any missing pages or uncertainty about later changes. Use counsel or the court’s resources to confirm the filing requirements; factual preparation does not establish eligibility or jurisdiction.

ItemWhy It MattersCommon Miss

Modification historyMultiple orders or amended terms can change what is supposed to be registered.Treating the first order as the only order.
Issuing court and case informationThe issuing court, case number and court location identify where the order record can be checked.Documents that cannot be reliably linked to the issuing case.
Party and child address detailsMailing and notice issues can still matter even though the order already exists. No current address history or contradictory residence information.

What To Gather Before Filing Starts

The Full Order Set

RCW 26.27.441 calls for a registration request, two copies of the custody determination including one certified copy, and a statement under penalty of perjury that, to the best of the applicant's knowledge and belief, the order has not been modified. Organize later orders and the issuing court details so counsel can identify the determination to register.

Case and Court Identification

Record the issuing court’s name, location and case number as shown on the order. Keep those details with each later order so the documents can be matched to the correct case.

Mailing and Address Facts

Organize the names and notice-address information required for registration. RCW 26.27.441 makes its address requirement subject to RCW 26.27.281; raise safety or confidentiality concerns with counsel before including a protected location.

The Current Practical Problem

Write a separate dated account if there is a missed return, suspected concealment or another current enforcement concern. Do not let preparation of a registration file delay urgent legal advice or necessary emergency help.

Keep registration and enforcement records distinct

Registration Is About the Order Record

Registration preparation centers on the custody determination, its modification history and the required supporting information. Counsel assesses the legal process and which order should be registered.

Enforcement Is About Current Conduct

For an enforcement concern, preserve the relevant order terms, current location information, exchange details and communications. State which facts are verified and which remain unknown.

Some Cases Need Both

Use one set of records for the order history and another for current conduct, with dates linking them where needed. That lets counsel assess both questions without confusing a missing document with a new incident.

Out-of-State Registration FAQ

Is registering an out-of-state order the same as enforcing it?

No. They are connected, but registration focuses on the order record while enforcement usually focuses on what is happening now.

Do I need every modified order, or just the newest one?

Gather the full order history, including later changes, so counsel can identify the controlling determination and the documents required for registration. Do not assume an older order remains unchanged.

Can a PI decide whether registration is legally required?

No. Registration strategy is a legal question for counsel and the court. A PI helps clarify address, location, and chronology facts around the practical problem.

When does locate work help in a registration-related file?

Locating may help when a permitted notice address or current residence is uncertain. Discuss any protected-address or safety issue with counsel first, and limit the task to lawful information gathering.

Check the facts needed for the registration process

If counsel identifies an address or chronology gap, share that specific question and the relevant orders. We can assess available records or locating work and provide findings without choosing the filing strategy.
