Washington Parenting Plans and Relocation

Start with the parenting plan that is in force and the dates you believe it was not followed. A proposed move, a temporary deployment arrangement and a request to change the plan can raise different Washington requirements. These notes help you organize the facts for your attorney, without deciding the legal route for your family.

Before you rely on a rule or form

Use the current court instructions and the order in your own case. These notes explain factual preparation, not legal advice or a promise that evidence will be admitted. Check dated rule and form references with the official source before relying on them.

Parenting Plans and Relocation

Common schedule and enforcement questions

Keep each event tied to the applicable order term and its supporting records. Specific dates and effects on the child’s routine are more useful than a general description of conflict.

Holiday and Summer Schedule Disputes

For holiday, school-break and summer arrangements, preserve notice messages and record the ordered pickup and return times alongside what happened. Exact dates help distinguish an agreed change from a disputed departure.

Repeated Exchange Failures

For no-shows, lateness, changed exchange locations or missed returns, note each date separately. We can compare independent observations and messages across those dates without assuming every deviation has the same cause.

Communication and Co-Parenting App Records

Keep complete relevant text, email and co-parenting-app conversations. They may show a proposed change, notice, agreement or disagreement that an isolated screenshot would miss.

Supervised Visitation, Parenting Classes, and Third-Party Providers

Authorized supervised-visitation notes, parenting-class records and provider observations can document attendance or conduct. Read them with the order and other evidence; completion alone does not resolve every compliance question.

Post-Order Enforcement and Coercive-Control Patterns

Major vs Minor Modification Facts

A narrow schedule adjustment raises different questions from a major change involving safety, relocation or residential time. Ask counsel which process applies, then identify the events and records relevant to that request.

Adequate Cause and Modification Gatekeeping

Adequate-cause screening can be an early step in a Washington modification case. Bring counsel the dated events and supporting records behind the requested change; counsel and the court apply the standard.

Temporary Orders, Restraining Orders, and Supervised-Time Emergencies

A temporary-order request, an immediate restraint and an emergency supervised-time suspension involve different procedures. Identify the order being sought with counsel before deciding which disputed events need investigation.

Dispute Resolution and Escalation Boundaries

Review the plan’s dispute-resolution terms with counsel. Urgency, violence concerns or repeated noncompliance may require a different response. Preserve the history of attempted resolution where it is safe and relevant, without delaying urgent help.

Support Nonpayment Does Not Rewrite Parenting Time

Unpaid support does not itself authorize withholding parenting time, and denied time does not itself cancel support. Keep separate records of each obligation and ask counsel about the appropriate enforcement process.

Relocation Facts Beyond the Checklist

For a disputed move, document residence dates, school and childcare effects, travel arrangements and actual caregiving. Notice is one issue; counsel also needs the practical facts about how the move affects the existing plan.

Washington Parenting-Plan Forms and the 2025 Changes

The July 27, 2025 changes associated with SHB 1620 revised parenting-plan limitation provisions and related forms. Check the current Washington Courts forms and the official summary of changes rather than relying on an older template or a general account of the legislation.

Organize the actual events behind a proposed restriction: care and exchange dates, safety incidents, relevant orders, communications and firsthand witnesses. Distinguish observed conduct from clinical opinions or conclusions about another parent's character.

A single incident can matter. Some statutory categories concern a pattern or history, while others do not require a series of incidents. Do not wait for another incident before seeking safety or legal help, and do not assume that a protection order or an allegation alone determines the parenting-plan outcome. Counsel connects the facts to the applicable provision and the court decides the findings.

For practical scheduling disputes, keep the existing plan's exact holiday, school-break, notice, supervision and exchange terms with the dated records of what occurred. Investigation can clarify those facts without selecting or drafting your legal position.

The July 2025 changes reorganized FL All Family 140's limitation provisions into attachments and introduced FL All Family 141, Supervised Visitation Acknowledgment, and FL All Family 168 and 169, the temporary suspension request and immediate order with hearing notice. Match your records to the current forms rather than an older template.

Current RCW 26.09.191 excludes qualifying good-faith protective actions from abusive-use-of-conflict and protracted-withholding categories. Document the event, safety concerns and resulting action rather than assuming every protective step is obstruction; counsel assesses whether the statutory definition applies.

Modification Questions, Adequate Cause and Deployment

Washington parenting-plan changes can follow different statutory routes under RCW 26.09.260. Where adequate cause under RCW 26.09.270 is required, counsel addresses that initial screening before a full modification hearing. A minor adjustment and a major modification are not interchangeable, and a record of conflict does not automatically establish either.

  • Start with the existing order: Keep the final plan, earlier changes and the dates when the disputed circumstances arose.
  • Document the claimed change: Connect residence, caregiving, work schedules, school needs, safety events or exchange problems to dated records and firsthand sources.
  • Separate temporary military arrangements: Keep duty, deployment and return dates with the care and communication arrangements. Temporary military duties are not by themselves a basis for a permanent reduction in parenting rights; any delegation or temporary order has its own conditions.

We can verify disputed routines, residences or events. Counsel determines eligibility, the procedure and the legal significance of the resulting facts.

Under RCW 26.09.270, the party seeking a covered modification supplies an affidavit of supporting facts and gives notice and a copy to the other parties, who may file opposing affidavits. The court denies the motion unless the affidavits establish adequate cause for a hearing. That screening is not a final decision to change the plan; the label 'minor' does not itself settle whether screening applies. RCW 26.09.260(6) treats a modification pursued with a proposed relocation differently. Counsel should identify the applicable route and exceptions.

Repeated informal complaints do not automatically establish a modification ground. One statutory example in RCW 26.09.260(2)(d) concerns at least two court contempt findings within three years for failure to comply with residential-time provisions, or a first- or second-degree custodial-interference conviction. Keep the actual orders and dated events; counsel assesses the remaining statutory requirements and whether enforcement or modification is appropriate.

Relocation

Washington Law and Court Sources

The official sources below address investigator licensing, parenting plans and custody jurisdiction. Counsel should review the current order and applicable relocation requirements before you act.

Relocation Notices, Objections and Temporary Orders

Do not wait for an investigation to address a relocation deadline. Washington's relocation provisions distinguish who must give notice, how it is delivered, objections and temporary orders. Counsel should review the current order and calculate the dates that apply to your proposed or completed move.

RCW 26.09.430 identifies notice obligations. The ordinary formal-notice timing is at least 60 days before the move; the limited five-day provision concerns when required information was not and could not reasonably have been known in time and delaying the move is unreasonable. Moves within the same school district and protected-information situations have different provisions. Keep the notice, delivery proof, when information became known and subsequent updates. Objections commonly involve a 30-day filing and service window; confirm your own deadline promptly.

For a temporary order allowing, restraining or requiring return after a move, preserve the actual notice history and compare schools, caregiving, employment, housing and realistic travel. Permission pending a final hearing and an order preventing a move have different statutory considerations. We document those facts; counsel presents the request and the court decides it.

Care, Duty Schedules and Access

The Washington Courts forms directory provides statewide forms and notes that individual courts may require additional forms or local rules. Check the instructions for the court handling your matter with your attorney. An investigative report does not replace a required declaration or filing.

Can a PI help during a deployment custody dispute?

Yes. We can document temporary care arrangements, the child’s routine and specific events during deployment. The Servicemembers Civil Relief Act (SCRA) provides certain protections, which counsel should assess for your case; it does not itself prevent lawful evidence gathering.
